Mini-Miranda Notice: This communication is from a debt collector. This is an attempt to collect a debt and any information obtained will be used for that purpose.

1. OVERVIEW AND SCOPE

As a receivables management and third-party debt collection agency, the scope of information we collect and process depends on the accounts placed with us by creditors and your interactions with our online and communication platforms. This policy works in conjunction with our state-specific disclosures and federal financial privacy notices.

2. INFORMATION WE COLLECT

We collect personal information to service accounts, process transactions, fulfill legal obligations, and communicate with consumers. We collect information from the following primary sources:

D. Information Collected Automatically via Web Technologies

When you visit our website or online portals, we automatically collect technical data, including:

  • Internet Protocol (IP) address, browser type, operating system, device identifiers, referring URLs, and language preferences.
  • Interaction data, including time spent on pages, buttons clicked, mouse movements, and session analytics gathered through cookies and tracking tools.

E. Information from Third Parties and Public Sources

We may obtain information from third parties to verify your contact details and credit history, including:

  • Consumer reporting agencies (credit bureaus) regarding creditworthiness and credit history.
  • Skip-tracing vendors, asset location services, public record databases, and government agencies.

3. HOW WE USE YOUR INFORMATION

Nexa uses personal information strictly for lawful receivables management and business operational purposes, including:

  • Account Servicing & Debt Collection: Verifying identity, processing payments, negotiating settlements, responding to disputes, and executing account management duties as permitted under the Fair Debt Collection Practices Act (FDCPA) and state laws.
  • Multi-Channel Communications: Contacting you regarding your account via mail, telephone, email, SMS text messaging, or automated virtual agents.
  • System Optimization & AI Training: Monitoring, auditing, and enhancing our communication software, web portals, and virtual call agent algorithms.
  • Fraud Prevention & Security: Detecting security incidents, protecting against fraudulent or unauthorized transactions, and verifying consumer identities.
  • Legal and Regulatory Compliance: Complying with federal and state obligations, court orders, administrative subpoenas, and regulatory audits.

4. DISCLOSURE OF INFORMATION AND FDCPA RESTRICTIONS

Nexa does not sell, rent, or trade personal information. Under the Fair Debt Collection Practices Act (FDCPA, 15 U.S.C. § 1692c(b)), we do not disclose nonpublic personal information to third parties without your prior direct consent or as permitted by law.

We share personal information exclusively with the following entities:

  1. The Consumer & Authorized Representatives: The consumer, their attorney of record, or an explicitly authorized agent.
  2. Clients & Creditors: The original creditor, account owner, or prior debt holder.
  3. Consumer Reporting Agencies: Major credit bureaus in accordance with the Fair Credit Reporting Act (FCRA).
  4. Contracted Service Providers: Vetted vendors who perform technical, administrative, or processing services on our behalf (e.g., payment gateways, mailing houses, web hosting providers, telecommunications carriers, and virtual agent hosting infrastructure). These providers are bound by strict contractual confidentiality requirements.
  5. Legal & Regulatory Bodies: Law enforcement, regulators, or judicial bodies when legally compelled by subpoena or court order.

5. SMS/TEXT MESSAGING AND MOBILE COMMUNICATIONS (10DLC COMPLIANCE)

To facilitate convenient communication, Nexa provides automated and two-way SMS text messaging services.

  • Strict 10DLC Non-Sharing Guarantee: Mobile information, telephone numbers, and text messaging originator opt-in data/consent will not be shared, sold, or conveyed to any third parties or affiliates for marketing or promotional purposes. All categories of mobile consent exclude text messaging originator opt-in data; this information is strictly ring-fenced for account servicing communications.
  • Consent & Rates: By providing a mobile phone number to Nexa or our client, you confirm that you own or are authorized to manage the number. Message frequency varies based on account status. Standard message and data rates may apply.
  • Opt-Out Instructions: You may opt-out of text communications at any time by replying STOP to any text message sent by Nexa. Upon sending STOP, an opt-out confirmation message will be transmitted, and further SMS communications to that number will cease.
  • Assistance: Reply HELP to any text message for customer service support details.

6. COOKIES, TRACKING TECHNOLOGIES, AND ANALYTICS

Our website uses cookies, web beacons, and similar tracking technologies to ensure portal security and functionality.

A. Categorization of Cookies

  • Strictly Necessary Cookies: Required for core website functions, secure portal authentication, payment processing (e.g., Paymentus, PayPal), reCAPTCHA anti-spam verification, and session state management. These cookies cannot be disabled.
  • Performance & Analytics Cookies: Optional cookies (such as Google Analytics) used to capture anonymized usage data, visitor navigation paths, and technical error logs to improve platform performance.

B. Session Recording

We may utilize session recording and analytics technology to record mouse movements, page clicks, form entry fields (excluding masked payment/SSN fields), and browsing behavior to optimize portal usability and prevent fraud. By using our web portals, you consent to this monitoring.

C. Do Not Track (DNT) Signals

Certain modern web browsers transmit “Do Not Track” (DNT) signals. Because no uniform industry standard exists for interpreting DNT signals, our site does not currently respond to automated browser DNT mechanisms.

7. DATA SECURITY AND UNSECURE E-MAIL WARNING

We maintain technical, physical, and procedural safeguards that comply with federal standards (including the GLBA Safeguards Rule) to protect personal information against loss, misuse, or unauthorized access.

Important Notice Regarding Unsecure Electronic Mail: Standard email messages transmitted across the internet are inherently unencrypted and unsecure. We strongly advise consumers not to send sensitive personal identifiers (such as Social Security numbers, bank account details, or payment card data) via standard email. Nexa is not liable for data interception occurring across unencrypted public network connections initiated by the consumer.

8. STATE-SPECIFIC PRIVACY RIGHTS (CALIFORNIA RESIDENTS)

Residents of California have specific privacy rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). These rights include the Right to Know, Right to Delete, Right to Correct, and Right to Limit Sensitive Data Usage.

To review our complete California disclosures or submit a verifiable consumer request, please view our California Disclosures and Privacy Policy Page or submit your request through our dedicated CCPA Webform Link.

9. CHILDREN’S PRIVACY AND AGE RESTRICTION

Our website, payment portals, and collection services are intended strictly for adults aged eighteen (18) and older. Nexa does not knowingly solicit or collect personal information from individuals under the age of 18. If we confirm that a minor under 18 has submitted personal information through our online portals, we will purge the data from our active systems immediately.

  • No Legal or Credit Advice: The information provided on our website is for administrative and informational purposes only and does not constitute formal legal, tax, or financial advice.
  • External Links: Our website may contain links to third-party websites (such as payment processing modules or government databases). Nexa assumes no responsibility for the privacy practices, security, or content of external third-party sites.

11. REVISIONS TO THIS PRIVACY POLICY

Nexa reserves the right to modify or update this Privacy Policy at any time. Any changes will become effective immediately upon posting the updated policy to our website. The “Last Updated” date at the top of this page indicates when the latest modifications occurred. Your continued use of our web portals or communications platforms after an update constitutes acceptance of the modified policy.
